No Justice in Queensland Update

Today saw a national day of action with rallies calling for the sacking of the director of Public prosecutions as well as calls for charges to be laid against Snr sergeant Hurley and also for the Premier and Police Minister to stand down.

Rallies were held in Brisbane, Sydney, Melbourne, Townsville as well as Palm Island itself. The rallies were peaceful but the anger of the crowd particularly the Indigenous people was clear.

The Premier Peter Beattie to his credit went to Palm Island and addressed the crowd and restated his view that it would be wrong of him and would interfere in the justice system if he ordered the DPP to seek a second opinion.


he did however say that he would support the DPP if she chose to seek an independent opinion which would probably take the form of a DPP from another state.

The premier was met with many angry interjections from an understandably angry and emotional crowd.

It would seem that the Premiers comments with regard to the DPP was his way of telling her she should do this without being seen to contradict his earlier and continuing statements that he could not interfere in the Justice system and it can only be hoped that the DPP takes heed of this call and responds with the seeking of an independent opinion.

I personally still think the Premier could and should set up an inquiry in to the whole affair. While the death is obviously the most important thing the whole investigation after the incident needs to be examined.
We had friends of the policeman involved investigating him. He dined with them when they arrived to interview him. He failed to tell the relatives of the dead man he was dead when they asked when he would be released. The Criminal Misconduct Commission was not notified as soon as the incident happened.


There are just to many questions that need answers.

No Justice for Aboriginals in Queensland

What is going on in the Australian state of Queensland?

An aboriginal man affected by alcohol makes some rude and offensive comments to a police officer. He is arrested for this and a few hours latter he is dead in the holding cells of the Palm Island Police station.

His liver has been ruptured and almost split in half and he has four broken ribs.
The man cries out in pain and receives no treatment other then a cursory inspection. It is then discovered that he could be dead. An ambulance is called and the man is pronounced dead.

His family visits the police station to find out when he will be released and they are sent away with no one told of the fact that he is dead.

Police who are personally know to the arresting officer are sent out to investigate and they are meet by the arresting officer and in fact share dinner with him that night.

The Deputy State coroner investigates the death and finds that the arresting officer should be held accountable for the death.

The Director of Public Prosecution however finds that in her opinion there should be know charges laid and cites but does not present additional evidence. Her finding is delivered in a one page statement unlike the coroners report which is a 35 page statement based on a lengthy hearing that took place over 18months.

The Queensland Crime and Misconduct Commission also find that no disciplinary charges should be laid against any police officer.

The only people apparently now left to investigate the police officer are the police themselves.

Both the Premier Peter Beattie and Police Minister refuse any further investigation and tell the Palm Island community that they should accept the decision and move on

A man is picked up for offensive language and is dead a few hours latter yet no one is responsible for anything that happened to this man.

There are so many questions that need to be answered.

How did the Deputy Coroner get her findings so wrong?

What is the extra evidence the DPP claims to have seen to persuade her to issue her findings?

Why has she not revealed how she came to this conclusion and the same goes here for the CMC?

Why was the family not told of his death when they presented to the Police station?

How does someone in custody wether wrongfully or rightfully die in a police holding cell?

How can any police investigation be taken seriously when the officer under investigation dines with those who are investigating him?

There are plenty more questions that need to be answered and as the Premier of this State Peter Beattie needs to hold an inquiry into all of these questions.
Aboriginals in this state and in the rest of Australia for to long have been met with the crocodile tears and tut tuts of white politicians over their plight and the injustices served out to them but when it comes to the crunch they are treated how the have always been since colonisation. As second-class citizens. How about a fair go for all?

If this was some middle class white guy dead in a police holding cell in Brisbane I sadly feel the whole thing would be treated very differently.

I ask for people everywhere not just Queensland, not just Australia but all those who support justice to ask why and demand answers.

In what can only be described as absolutely shameful insensitivity Queensland's premier Peter Beattie has offered to pay the fine issued to singer Robbie Williams for breaching anti-smoking laws by having a cigarette while on stage performing at the allegedly non-smoking venue of Suncorp stadium.

Premier Pete's apparent largess comes at the same time that he refuses to do anything to help deal with the Indigenous community of Palm Island's outrage over the Director of Public Prosecutions decision to not large charges against a police officer who was found to have caused the death of an Aboriginal man in his custody

Justice denied in Queensland

Another Aboriginal dies in police custody and despite a coroner’s report which places the blame squarely at the feet of the arresting officer the Queensland Director of Public prosecutions chooses to not prosecute the officer.
Welcomes to Queensland where justice appears to go missing for members of the indigenous community.
The Queensland DPP today announced that she believed there was not enough evidence to lead to any chance of a conviction and in fact went further and stated that this was a tragic accident. Read her transcript here

Punks not Dead

The car pulled up abruptly outside the house its various grinding and squeaking noises taking a moment to subside as the ignition is turned-off. Simon was sure this was the address. He had visited here once before but that night like most nights was a blur of light, sound and innate conversations. A light was on in the house so he assumed there must be someone up besides it was only 11:30 and in the whole time he had know David he had never seen him asleep before midnight. Well unless he was crashed out after another long weekend of no sleep and way to many lines of speed.

Simon stumbled in the dark up the stairs and suddenly a huge bark bellowed out from inside the house. The dog he'd forgotten about it. At the same moment the door swung open he heard a babies cry and the voice of female scream out “who the fucking hell is coming round at this time Christ the babies up now!” He knew that voice it was Annie’s

John Howard has continued to stick hard to the “stay the course line” in Iraq while U.S. president George Bush considers blowing the war and getting out while he still can.

In the wake of the release of the Iraq Study Group report and the comments of new elected defence secretary Dr. Bob Gates that the U.S. is not winning in Iraq it seems everyone except the Australian federal Government believes that it is time for a rethink on current strategies to resolve the situation in Iraq. Even George Bush no long uses the term “staying the course”. As the Bush administration comes to realise that Iraq was a mistake conceived on a lie and attempted with no long term strategy and as the body count continues to mount for U.S. troops (just short of 3000 now) the U.S is desperate to get its troops out of there

It seems that following the release of the Commonwealth ombudsman’s report that showed ten Australian citizens had been wrongfully detained by the Immigration department no one within the Federal Government wants to take any blame for it.

It leaves one to ask the question “What does it take for a Government Minister to accept ultimate responsibility and if they don't then who does

Labor must Act!

For Labor to have any chance of winning at the next election there must be a change of leadership tomorrow.

Beazley is a shot duck he is electoral baggage who has lost all relevance to a public that sees him as a waffler, klutz, part of an ALP aristocracy and worst still a two-time loser
