The Libertarian Solution: A Deeper Look at the Un-Answered Questions about the Limits of Rights

From the very first Continental Congress, that would pave the way to deciding the direction of what would later become the United States of America, there has always been a cog in the well oiled machine that decision makers are forced to work around.

A cog that that causes panic, fear, rumor and innuendo when it comes to conversations surrounding the true intent of the founding fathers belief in the radical notion of freedom and the limits that would have to be imposed for every citizen to enjoy the same rights equally.

The very idea of limiting some of the rights guaranteed in the Constitution to protect the people from actions of government has been enough for some to question whether or not the majority of Congressmen and Congresswomen on Capitol Hill have taken the time to read the Constitution and Bill of Rights while other larger questions remain.

Larger questions about whether or not American citizens are willing to go “all the way” in honoring the black and white simplicity the Constitution gives every citizen to live their lives as they see fit or if the Constitution is truly a living and breathing set of ideals that can change with the direction of the world.

A direction that swings from left to right and everywhere in between at a radical pace that is sometimes hard to keep up with but always brings America back to the same fundamentals that forces citizens to look deeper into the principles of Democracy, Opportunity, Equality and the broad subject of Freedom.

Somewhere beyond the topics of the day, these are things our founding fathers were hoping would stand the test of time but always get bloodied and bruised when we nitpick at the revisionist history of how we got there.

For everything the Civil Rights, Women’s Rights and the Current Gay Rights movements are doing and have done to provide equal opportunities for all American citizens there are nagging questions about the things that had to be done to correct wrong’s in the system and what right’s had to be taken away from others for this to happen.

Absolute Freedom is among the most radical notions that exist in the world.

The rights that are given to protect our homes, families and personal well being must be protected just as much as our neighbors right to not be forced to invite someone into their home for whatever reason they see fit.

It’s the simplicity of the notion that Americans live in a society that protects the absolute rights to speech against government action just as much as speech against sexual orientation, race and gender that clouds over discussions about the things that have been and will be done by the federal government to infringe on the freedoms of the few for the protection of the many.

When it comes to these infringements, the first thing that comes to mind is the aspect of enforcing policies that protect the public domain.

Policies that oversee the hiring and business practices on the federal level and also oversees the policies of any other company that receives federal assistance.

While it may be simple to comprehend the idea of the federal government living up to the standards set in the legislation passed in their own houses on Capitol Hill; the situation that has no end is the expectations put on private businesses to honor the rights of their fellow man, woman and child.

Contrary to popular belief, the Constitution and Bill of Rights only serves as an agreement between the people of the United States of America and the Federal Government.

When we stop and think about the all the things left on the table for the American people to figure out amongst themselves in a melting pot that includes people from every nationality across the globe, every form of religion, millions of free thinking individuals who have different ideas of how government should be ran and a need to ensure that each and every one of these citizens is given the right to practice or not practice the religion they see fit, is given the equal rights to life liberty and the pursuit of happiness and is protected from having these rights infringed by other citizens we can begin to understand how difficult of a balancing act our legislators are forced to perform.

When we truly think about it there is no such thing as absolute freedom.

Our rights are infringed on in our daily lives when it comes to legislation that is enforced to protect the greater good in the public domain.

Legislation that protects our children from predators, our well being in crowded facilities to prevent panic along with the rights we give back to the federal government in protection of the public from the shadowy figures that are looking to destroy the American way of life.

For the rights American Citizens are forced to forsake for the greater good; the question of whether it follows the intent of our forefathers is always asked.

For this question, American citizens must look at the deeper meaning of the words “Pursuit of Happiness”, “All Men are Created Equal” and the most powerful word of all “Rights”.

Once this is done we can become more appreciative of the things we have accomplished as a society in moving closer to achieving equal rights for all people and can move past the over analysis of how things “should have been done” to honor the Constitution instead of the opportunities that stand before us to move forward.
